So...I've been working at a sales job for about 5 months now, but two days ago I got offered a job at a hotel for a steady pay rate instead of commission, plus better hours. So I took the hotel job and quit my sales job. After working at the hotel for two days, I just got laid off. Via text. I even confirmed that I was being laid off and not fired.
So my question is...if I left a job of 5 months for another job, and then got laid off from the new job after only 2 days, can I still apply for unemployment benefits?
Also, I now am coining the phrase "Not good luck, not bad luck, just Desu luck."

Did you leave on good terms with your previous employer? Would you go back? If so, call them up and tell them the situation, see if they're feeling sympathetic.

Did you burn your bridges at your last job? You should see if they have already filled the position.
While I'm no expert I don't think you qualify for unemployment no matter what the situation. I believe that you normally have to work somewhere for a year to get unemployment, so you don't qualify from the hotel job. And since you left the sales job voluntarily you don't qualify there either even if you had worked there a year. Either way I'm pretty sure no unemployment for you.
I'd suggest you go beg for your old job back.

Nope. The sales company I was working with has a 'No rehire' policy. No matter how good of terms you leave on, if you quit, you're ineligible for rehire.

The 'sales and marketing' (read: door to door sales) job has a 'no rehire' policy. Meaning that if you quit, no matter how good the terms, you are ineligible for rehire. If you're confused by this, google "Cydcor"- the company I was with was a subsidiary of Cydcor that sold AT&T U-Verse door-to-door. :-/

Another "No" response.

In my experience the unemployment people don't care who you worked for, just how much you worked and you can always apply for unemployment. They will determine if you're eligible or not. You can always talk to them and ask questions too.

Ok. Out of the past year, I've worked all but about 6 weeks. Well over 180 days.

Since you didn't quit your last job I don't know how they would disqualify you.

Because none of the days from his sales job are eligible. He chose to quit that job himself.

So they're going to punish me for taking a better job and being laid off soon thereafter through no fault of my own?

Your state will be different, but in Texas as long as you've been employed (anywhere) regularly for some period of time (I didn't look that hard at the formula) before you apply for unemployment benefits, you're eligible.
I'd say get on down to the unenjoyment office on Monday.

That's what the plan is.

I would check with your state unemployment office because this is a somewhat unusual case and the eligibility requirements vary from state to state, but my guess is that you will not be eligible.

Should be ok for unemployment, just don't expect a lot of money.

I just need enough to live on until I can find another job.

But I cannot do without being nosey, because it's not possible that in those two days at the Hotel nothing happened that could have motivated your firing. You didn't see anything strange going on? Did you argue with someone? Were you late the second day? Because that experience of yours is too strange not to raise some curiosity.

Door to door sales sucks. I almost worked for some place called Vector Marketing, but quickly figured out that it was basically a well-disquised/presented scam.
I don't know much about unemployment, but I hope you find another job soon.

Nope. I was early both days. Everybody who worked with me said I did a great job and were impressed with my professionalism. However, the hotel was...not managed very well and nobody but the owner had been there for more than about 8 months. I asked the manager why I was being let go and what I did to cause it and her reply, which I have in text, was "Nothing... I apologize but we do need to let you go." I asked if I was being fired with cause or being laid off and she said I was being laid off.

Vector Marketing is essentially the same thing as Cydcor: A pyramid scheme. It CAN work for a very rare few, but for most people it's just a grinder that costs them more money than it makes them.

Once they told us to sell to family first, the "octopusnope.jpg" kicked in. The whole thing sounded too much like a high school fundraiser.

You're probably correct, but I'd still talk to them if I was him. You never know how it will go.

Now it's clear: the bitch hired you without the owner's previous approval, and had to fire you not to be fired herself. You should sue her for for loss of future earnings, and procured severe psychological damage! And you're right: it was just bad luck, to be hired by an incompetent manager. As an Italian, I could suggest that you may want to look for a Catholic Church, to receive a good Blessing. You can tell them I sent you.

Just apply, all they can do is say yes or no, I think you can do it online also.
